Aspex wins appeal for magnetic clip patent

On August 12, 2004, the Court of Appeals for the Federal Circuit issued a 13 page decision reaffirming the validity of Aspex's 545 patent.

The three judge panel unanimously ruled to vacate the Florida District Court's order invalidating 2 of the patent's 34 claims, and remanded the case to the District Court for further proceedings consistent with the Appellate Court's decision.

Aspex had filed a lawsuit for patent infringement against Concepts In Optics, Inc. before the US District Court of the Southern District of Florida (docket # 00-7067-CIV-Moreno/Dubé). The 545 patent is a cornerstone patent in the field of magnetic clip-on eyewear.
